General Terms and Conditions (GTC)
1. Scope of application and contracting parties
1.1. These General Terms and Conditions (GTC) apply to all contracts concluded between you as a customer and us, The Car Enthusiast, via the online shop.
1.2. Deviating or supplementary conditions of the customer shall not become part of the contract.
2. Conclusion of the Contract
2.1. The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding online catalog.
2.2. The purchase agreement is concluded when the customer, by clicking the button "place order with payment obligation", submits a binding offer for the goods contained in the shopping cart.
2.3. Confirmation of receipt of the order (by email immediately after submission) does not yet constitute acceptance of the offer. Acceptance only takes place through a separate order confirmation or shipping notification by the seller.
3. Prices and Payment
3.1. The prices stated are final prices, include the statutory Austrian value-added tax and all other price components.
3.2. In addition, there are shipping costs, which are outlined in our shipping policy.
3.3. Payment is made at the customer's discretion using the payment methods offered during the ordering process.
4. Shipping, Delivery and Availability
4.1. Order Processing: We would like to point out that the products are not stored by us, but are shipped via international suppliers.
4.2. Delivery Times: The delivery time is usually [e.g. 7 to 15 business days] after receipt of payment (see our shipping policy for details). We are not liable for delivery delays caused by third parties (customs, transport companies, suppliers).
4.3. Customs and Import Duties: We strive to cover all customs duties and import sales taxes incurred for you. Should you unexpectedly be asked to pay by the shipping company, we will fully reimburse you for these costs upon presentation of proof of payment.
4.4. Partial Deliveries: We are entitled to make partial deliveries, provided that this is reasonable for the customer.
5. Warranty and Liability
5.1. The statutory warranty provisions under Austrian law apply. The warranty period is two years from the date of delivery of the goods.
5.2. If the purchased item is defective, the customer may initially demand that the defect be remedied (repair) or that a non-defective item be delivered (replacement delivery).
5.3. We are only liable for customer damages in cases of intent or gross negligence. In the case of slightly negligent breach of essential contractual obligations, our liability is limited to the typically foreseeable damage.
6. Retention of title
The delivered goods remain our property until the purchase price has been paid in full.
7. Right of Withdrawal (Legal Notice on Right of Withdrawal)
The statutory right of withdrawal applies, which is detailed in our separate cancellation policy on the website. The deadline is 14 days from the day on which you or a third party designated by you took possession of the last goods.

10. Final Provisions
10.1. The law of the Republic of Austria shall apply, to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG).
10.2. The place of jurisdiction for all disputes is the registered office of our company in Austria, provided that the customer is a consumer with a habitual residence in Austria. If the customer does not have a residence in Austria, the place of jurisdiction is Vienna.
10.3. The language of the contract is German.
